Building Regulations Principal Designer Advisor

The Principal Designer, as defined under the Building Regulations, is intended to be the same entity as the Principal Designer under the CDM Regulations.

As with the introduction of the latest iteration of the CDM Regulations in 2015, it is understood that the lead designer will inherit the Building Regulations Principal Designer role by default, with the role and duties likely to be incorporated within tenders and client scopes of service when being appointed for the lead designer role.

The focus of the Principal Designer role under the Building Regulations is to ensure compliance with the Building Regulations.

The new Building Regulations Principal Designer role will require the lead designer to take on board significant additional duties and liability in relation to the Building Regulations, relating not only to their own design, but also creating an additional responsibility for oversight of other design disciplines to ensure holistic compliance with the Building Regulations.

BS4's Role:

The Building Safety Act recognises that those appointed as Principal Designer may not have the requisite in-house skills, knowledge or experience to fully satisfy this responsibility on all types of projects and may therefore want to appoint an external organisation such as BS4 as a sub-consultant to undertake or assist them with discharging the duties of the Principal Designer and ensuring a designs compliance with the Building Regulations. The new Building Regulations Principal Designer role will require the design and build contractor to take on board significant additional duties and liability in relation to the Building Regulations, relating to the design procured by themselves and that of any sub-contractors with design responsibility.

Building Regulations Compliance Reviews

Principal Designers, Designers and Contractors working under the Higher Risk Building Regime may require support and advice from a specialist Building Regulations consultant to ensure the designs they are producing are compliant with the Building Regulations.

With pre consultation with the Building Safety Regulator not being an option under the Higher Risk Building Regime, anyone with design responsibility may require additional support in understanding the complexities of Building Regulations compliance.

BS4's Role:

BS4’s in house Building Control experts can provide design reviews at agreed stages by a competent Registered Building Control Inspector of Class 3, which is the equivalent level of the inspector that will be an integral part of the Building Safety Regulators multi-disciplinary team. Such independent reviews will give confidence to the client and designers that the design has indeed been progressed in compliance with all relevant statutory and best practice requirements prior to submission to the Building Safety Regulator.
